E' stata finalmente pubblicata nella gazzetta ufficiale del 28/12/07 la legge 24 Dicembre 2007, n. 244 (la trovate in formato PDF qui ) che da questo punto in poi chiamerò semplicemente Legge Finanziaria 2008. La Legge proroga tutte le agevolazioni previste dalla finanziaria 2007, fino al 2010 e introduce le seguenti novità:
- Possibilità per i comuni di far pagare, a chi installa impianti energetici (elettrici e/o termici) da fonti rinnovabile, un'aliquota ICI ridotta, inferiore al 4 per mille (Art. 1 punto 6);
- are subsidized up to the end of 2009, any replacements of heating non-condensing (2 million euro per year allocated to this facility) (Article 1, paragraphs 20 and 21);
- The deductions may be divided in equal annual installments from a minimum of 3 to a maximum of 10 years in the taxpayer's irrevocable choice (Art. 24 paragraph 1 letter b);
- E 'I have simplified the procedure for requesting relief for the sole replacement of fixtures and the installation of solar panels, since it is no longer necessary to provide a certificate of qualification / certification efficiency;
- Sono previste agevolazioni fiscali per il gasolio e il gpl utilizzati in zone montane e per le reti di riscalamento alimentate a biomassa o energia geotermica (Art. 1 punto 240);
- La detrazione è prevista anche per la sostituzione di impianti di climatizzazione invernale con impianti geotermici e con pompe di calore ad alta efficenza (Art. 1 punto 286);
- Dal 2009 , per gli edifici di nuova costruzione, il rilascio del permesso di costruire è subordinato alla presenza di:
- Certificazione energetica dell'edificio (Art. 1 punto 288);
- Caratteristiche strutturali dell'immobile finalizzate water saving and reuse of stormwater (Art. 1 paragraph 288);
- plants for the production of electricity from renewable sources that can guarantee at least 1 kW for each unit. For industrial buildings with an area exceeding 100 square meters, the limit is 5 kW (Art. 1 paragraph 289).
